1.1. As long as the Card Member complies with the Terms and Conditions mentioned herein, the Company grants the Cardmember a non-exclusive,non-transferable, limited right to enter, view and use the Site. The Card Member agrees not to interrupt or attempt to interrupt the operation of the Site in any manner whatsoever or modify, sell or transmit any copy from the Site, including but not limited to any text, images, audio and video, for any business, commercial or public purpose.

1.2. The Card Member hereby acknowledges that the Site is provided on ‘As is’ basis. The Card Member’s uninterrupted access or use of the Site on such basis may be prevented by certain factors outside the J&K Bank’s reasonable control including, without limitation, the unavailability, inoperability or interruption of the Internet or other telecommunications services or as a result of any maintenance or other service work carriedout on the Site. J&K Bank does not accept any responsibility and will not be liable for any loss or damage whatsoever arising out of or in connection with any inability to access or use the Site.

2.1.All materials on the Site, including but not limited to audio, images, software, text, icons and such like (the "Content"), are protected by copyright under international conventions and copyright laws. The Cardmember cannot use the Content for any purpose, except as specified herein.

2.2. There are a number of proprietary logos, service marks and trademarks found on the Site whether owned/used by J&K Bank or any other third party.By displaying them on the Site, J&K Bank is not granting the Card Member any license to utilize those proprietary logos, service marks, or trademarks.Any unauthorized use of the Content may violate copyright laws, trademark laws, the laws of privacy and publicity, civil and criminal statutes.

3.1. If you send any communications or materials to the Site by electronic mail or otherwise, including any comments, data, questions, suggestions or the like, all such communications are, and will be treated by Bank, as non-confidential.

3.2. You hereby give up any and all claim that any use of such material violates any of your rights including moral rights, privacy rights, proprietary or other property rights, publicity rights, rights to credit for material or ideas, or any other right, including the right to approve the Way Bank uses such material.

3.3. Any material submitted to this Site may be adapted, broadcast, changed, copied, disclosed, licensed, performed, posted, published, sold, transmitted or used by Bank anywhere in the world, in any medium, forever.

4.1. Internet transmissions are never completely private or secure. You understand that any message or information you send to this Site may be read or intercepted by others unless there is a special notice that a particular message (for example, credit card) is encrypted (send in code). Sending a message to Company does not cause Company to have any special responsibility to you.

4.2. The copyright in the contents of this Site belongs to Company. Accordingly, Company reserves all rights. Copying of part or all the contents of this Site without permission of Company is prohibited except to the extent that such copying/printing is necessary for the purposes of availing of the services.

5.1. The Cardmember hereby acknowledge that through the Site, J&K Bank merely provides intermediary services in order to facilitate booking/redemption of tickets and hotel, recharge and other products/vouchers services to the Cardmember. J&K Bank is not the last-mile service provider to the Cardmember and therefore, J&K Bank shall not be or deemed to be responsible for any lack or deficiency of services provided by any entity such as airline, travel/tour operator, hotel, facility/merchandise or any other service provider or vendor or reseller, which a Cardmember shall engage or hire or appoint pursuant to or resulting from, the material available in the Site. J&K Bank will not be liable to Card Member or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense incurred through or by the usage of the Site

5.2. The Company in co-ordination with J&K Bank may add, change, discontinue, remove or suspend any other Content posted on this Site, including features and specifications of products described or depicted on the Site, temporarily or permanently, at any time, without notice and without liability.

5.4. J&K Bank and Company reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of J&K Bank’s systems and Cardmember’s data and interests remain well-protected. Towards such end, J&K Bank may take various steps to verify and confirm the authenticity, enforceability and validity of orders placed by the Card Member.

5.5. In case J&K Bank and/ or the Company, in its sole and exclusive discretion, conclude that the aforementioned orders placed on the Site reasonably fail to be authentic, enforceable or valid, then J&K Bank and/ or the Company have the right to cancel the said orders, without notice or intimation.

5.6. J&K Bank and/or Company reserves its right to deny in its sole discretion any user access to the Site or any portion thereof without notice.

5.7. All queries in relation to the Rewards Program may be addressed to Card Customer Service Toll-free number 956-077-7990 or written to rewards@jkbmail.com or as specified by J&K Bank from time to time.

6.1. The Company in co-ordination with J&K Bank may add to, modify or remove any part of these Terms and Conditions of Use at any time as it may deem fit, without notice. Any changes to these Terms and Conditions of Use or any terms posted on this Site apply as soon as they are posted. By continuing to use this Site after any changes are posted, you are indicating your acceptance of those changes.

6.2. The Company in co-ordination with J&K Bank may add, change, discontinue, remove or suspend any other Content posted on this Site, including features and specifications of products described or depicted on the Site, temporarily or permanently, at any time, without notice and without liability.

6.3. The Company reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of Company's systems as well as its clients and users interests are and remain, well-protected. Towards this end, the Company may take various steps to verify and confirm the authenticity, enforceability and validity of orders placed by you.

6.4. If J&K Bank and/ or the Company, in its sole and exclusive discretion, concludes that the said orders placed on the Site are not or do not reasonably appear to be, authentic, enforceable or valid, then J&K Bank and/ or the Company have the right to cancel the said orders.

6.5. J&K Bank reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any material posted herein, in any respect. J&K Bank and/or Company shall have no obligation to take the needs of any user into consideration in connection therewith.

6.6. J&K Bank and/or Company reserves its right to deny in its sole discretion any user access to this Site or any portion hereof without notice.

6.7. No waiver by J&K Bank and/or Company of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.

7.1. If any dispute arises between you and J&K Bank during your use of the Site or thereafter, in connection with and arising from your use or attempt to use this Site, the dispute shall be referred to sole arbitrator, appointed by J&K Bank, as per the Arbitration and Conciliation Act, 1996 and any amendments thereafter. The place of arbitration shall be Srinagar. The arbitration proceedings shall be in the English language.

7.2. These terms and conditions are governed by and shall be construed in accordance with the laws of the Republic of India.

8.1. These terms and conditions (“Terms and Conditions”) are an agreement between you and J&K Bank Limited (hereinafter referred as "J&K Bank") that governs your access to and use of Rewards Points.

9.1. Adjustments will be made to the Reward Points in case of any credits, including those arising from returned goods or services or billing disputes or excess credit by J&K Bank. If a disputed transaction is resolved in favor of the Card Member or where a transaction is reversed, proportionate Reward Points will be credit or reversed to the Card Member. A similar adjustment in Reward Points is made in the case of return of goods or a disputed transaction is resolved against the Card Member and proportionate Reward Points will be debited to or subtracted from the CardMember Account. In an event there are no Reward Points left to the credit of Card Member, J&K Bank may in its sole discretion may charge the Reward Points on the Credit Card of the Card Member.

9.2. If any time a Reward Point scheme is withdrawn, or cancelled, or is liable to be cancelled, or the Card Account is termed as a Delinquent Account, all the J&K Bank Reward Points then standing to the credit of the Card Member shall ipso facto stand immediately and automatically cancelled. Such cancelled Reward Points shall not be credited to the Card Account even if the Card Member reinstates his/ her membership with J&K Bank.

10.1. J&K Bank Card must not be overdue, suspended, blocked, cancelled or terminated by J&K Bank at the time of the receipt of request for redemption of Reward Points. J&K Bank retains the right to modify and introduce rules for redemption, without any prior intimation to Card Members.

10.2. Cardmember acknowledges that at the time of redemption of Reward Points for products or services through the Site, a purchase is directly made from a merchant and not from J&K Bank. Participating merchants determine (i) product prices and availability, (ii) offers, promotions and applicable restrictions, (iii) estimated shipping and (iv)estimated tax, all such factors are subject to change at any time without notice to the Card Member and are only confirmed in the order confirmation email sent by the respective merchants.

10.3. All rewards are subject to availability and on terms prevailing at the time of redemption.

10.4. J&K Bank retains the right to alter the number of reward points required to make a redemption from time to time. The redemption procedure and the additional terms and conditions for each reward shall be set forth in the redemption certificates or vouchers or partner terms & conditions issued to the Card Member.

11.1. Reward Points accumulated that are not redeemed by the Card Member within thirty-six (36) months will expire and stands forfeited.

11.2. In the event Credit Card is voluntarily closed by the Card Member or cancelled for any other reason, any outstanding Reward Points after cancellation of J&K Bank Card shall automatically lapse and shall stand forfeited.

11.3. If a J&K Bank Card, for any reason whatsoever, is blocked or suspended by J&K Bank, the Reward Points accumulated shall stand forfeited but may be reinstated, at the sole discretion of J&K Bank, if use of J&K Bank Card is reinstated.

12.1. While availing any products or services, J&K Bank or Company does not accept liability for damages, losses, or delays that may result from availing such products or services.

12.2. Any additional facility like meals, transportation, accommodation arrangements and/ or courier charges or further costs incurred in connection with redemption of any reward shall be the sole responsibility of the Card Member.

12.3. While accessing or using the services available on the Site, the Card Member shall not hold J&K Bank responsible or liable for any loss or damage, claims, costs, charges and expenses and/ or for any personal injury that may be suffered, to Card Member directly or indirectly, as a result of accessing or using the Site.

12.4. Fraud and/or abuse relating to earning and redemption of Reward Points in the Program shall result in forfeiture of the Reward Points as well as suspension and/or cancellation of the J&K Bank Card.

12.5. Card Member acknowledges and authorizes J&K Bank and the Company to share the details of the Card Member with third parties for fulfilment of redemptions.

12.6. Any taxes or other liabilities or charges payable to the Government or any other authority or body or any other participating merchant establishment which may arise or accrue to a Card Member on redemption of Reward Points, as aforesaid or otherwise, shall be chargeable to the sole account of the Card Member.

12.7. J&K Bank reserves the right to cancel, change or substitute the rewards or reward conditions or the basis of computation of Reward Points or terms and conditions of the Rewards Program at any time, without giving any intimation to the Card Member. J&K Bank can suspend or terminate the Program at any time, as deemed necessary, without any liability for the Reward Points earned.

13.1. Deals:

13.1.1 Deal codes will be sent to the registered email ID and mobile number of the Card Member only. No physical vouchers are sent.

13.1.2 Deal codes are valid for one time use only on the respective portal/store.

13.1.3 Deal Validity date will be mentioned in the email within which the E-voucher code is sent and the validity of an Deal code cannot be extended.

13.1.4 Deals cannot be cancelled.

13.1.5 J&K Bank does not decide the E-voucher terms and conditions. It is solely at the discretion of the merchant / brand which is the original issuer of the E-voucher.

13.2. Vouchers:

13.2.1 E-Vouchers will be sent to the registered email ID and mobile number of the Card Member only. No physical vouchers are sent.

13.2.2 E-Voucher codes are valid for one time use only on the respective portal/store.

13.2.3 E-Voucher’s Validity date will be mentioned in the email within which the E-voucher code is sent and the validity of an E-vouchers cannot be extended.

13.2.4 E-vouchers cannot be cancelled.

13.2.5 Card Members are required to read the voucher terms and conditions carefully prior to redemption.

13.2.6 J&K Bank does not decide the E-voucher terms and conditions. It is solely at the discretion of the merchant / brand which is the original issuer of the E-voucher.

13.3. Recharges:

13.3.1 Pre-Paid mobile users can redeem their Reward Points to recharge their mobile phones.

13.3.2 Card Members can recharge across all circles in India. While best efforts are made to share valid recharge denominations for operators/circles, neither J&K Bank nor the Company shall be held responsible for dynamic changes in these said plans whether it be on the operator’s end or otherwise.

13.3.4 If the Recharge value exceeds the redeemable value of the Reward Points available, the balance can be paid by using J&K Bank Credit Card.

14.1. The Terms and Conditions for Rewards Program shall be read in conjunction with the Card Member Agreement. The Rewards Program does not amend any provision in Card Member Agreement. Notwithstanding anything contained herein, in the event there is any contradiction between the Terms and conditions of the Rewards Program and the Card Member Agreement, the terms and conditions of Card Member Agreement shall prevail.
